NimRoderick Commission Terms of Service


These terms of service are for commissioning NimRoderick for any sort of artistic fun thing.  By placing an order, you are agreeing to these terms.  Don't worry, though; there's nothing too scary in here.  Most of this is just common sense.  Even so, take a few and give it a good read.


Descriptions:
  • PLEASE BE CLEAR AND CONCISE ABOUT WHAT YOU WANT!!!
  • When describing your piece, please be brief and to-the-point.  I recommend the use of bullet-notes. 
  • As tempted as you may be to include lots of flavour text or wordy descriptions, please realize that this makes things incredibly overcomplicated for me.  It means that I have to scan and re-scan a wall of unhelpful text in order to pick out the buried detail I need.  
  • When details are bullet-noted and brief, I can find what I need efficiently. 
  • I may send a wordy description back to you and ask you to shorten it with these guidelines in mind.  I will not work from paragraphs of text. 

References:
  • A reference can be anything that shows your character! Just as long as you provide clear images showing all the important details, they can be anything from game screenshots to an imgur gallery of art you've had done to whatever! 
  • Please be sure that your images are hosted somewhere reliable!  FurAffinity often has down-time or slows down to a crawl.  Facebook links can be complicated with permissions. Trillian links are not permanent.  I highly suggest uploading the references you wish for me to use be uploaded into a gallery on Imgur.com.  You do not need to sign up to post images.  
  • Remember to include references to all important aspects of your character!  If you give me a picture from one side, I cannot possibly know that the arm hidden behind his body is robotic.  Things like this come up more often than you'd think, so let's avoid this. 
  • It's okay to send me a reference with NSFW content, but please mark them accordingly.  I'd like a heads'-up before being assaulted by dicks. 

Content:
  •  I am happy to help you try to capture the imagery you have floating around in your mind to the best of my ability.  
  • I will gladly stream the process so you can watch me work on your piece live!  During this, we can chat, and you can help me shape the image closer to your envisioned ideal.  Please note, however, that all revision rules do still apply.  So please, be clear in your descriptions!
  • Please do note, I will NOT do anything considered 'adult' art.  PG-13 is the highest rating I'll go.  
  • While tasteful artistic nudity is fine, pornography is not.  Occasionally I'll do a suggestive piece, if the focus is clearly on demonstrating love and passion over just boner-fodder.  This is at my own discretion

Queue:
  • If you come up on my queue, but have not provided all needed information to proceed and cannot be immediately reached, I will leave you a message asking for whatever might be needed and move on to the next person.
  • You will then be next up again, and provided I've been able to reach you and get what's needed, I'll begin your piece upon the completion of the other one.    If not, then lather-rinse-repeat as long as needed. 
  • If you have a time when you really need your piece finished for, let me know as soon as possible. I can do rush-orders for an additional price, depending on just how soon you need it.  

Revisions: 
  • MINOR revisions: (small things, caught more or less on-the-spot)  I will revise a small detail up to three times.  After this, I will begin to charge based on the complexity and amount of effort needed, with a base cost of $5usd/ea.  Avoid this by being clear, decisive and descriptive!
  • MAJOR revisions: (such that would involve major backpedaling in order to do, be a huge pain in the butt, etc)  These are possible, but will incur a charge each time.  I will let you know if what you've suggested would fall into this category, and what it would cost,  before I begin the edit.  
  • Anything that would need to be altered because of indecision on your part, (such as deciding midway through an image that you want a different pose), will be dealt with on a case-to-case basis.  I am not responsible for your indecision, and will require compensation for the time and effort needed to change the image accordingly.
  • If a revision is major enough that I would have to undo half or more of the time it would take to complete your image,  then you will be charged for an additional illustration of the same value.  I will gladly complete the one you changed your mind about as well as creating the new one, to give you your full value, but you will be required to pay for two images if you wish for such a major revision.  
  • Should you foresee needing several edits, for things such as designing your character without a visual reference or creating a concept from scratch, you may instead opt to pay by the hour.   In such cases, the cost of time includes as many edits to as many things as you could possibly need, and you are free to be far more finicky. 
  • If a commissioner is difficult, routinely indecisive, or rude: There will be a note made of it, and future commissions will by default include an extra fee.  This can entirely be avoided by simply being polite, reasonable, and clear upfront on your ideas, however, and really shouldn't be an issue.  But, sometimes it is.  

Additions:
  • Should you decide that you would like more of an image than what has been established upfront, this is possible. However, you will be responsible for the difference in cost.  
  • I will not, under any circumstances, accept being asked to "just throw in" the difference.  
  • Only after payment has been received will I begin working on these additions.  It is unfortunate that I need to be so strict on this, but I have had issues with individuals attempting to 'play the system', taking advantage to score far more art than they paid for.  
  • Please note:  Those who outright ask for freebies or handouts are all but guaranteed to NOT get them.  

Cancellation:
  • if you cancel your order after signifigent work has been done on it, you will not be refunded more than the difference between the total paid and what a piece at its current state of completion would cost. 
  • If you cancel before your piece has been started, you will receive a full refund (minus whatever fees Paypal takes out).

Payment and Prices:
  • I accept Paypal only, and can be paid at ThePaintedPuppy@gmail.com
  • If I am streaming your piece, I ask for payment before I begin. 
  • If your piece is not being streamed, I will accept either full payment beforehand, or half upfront and half upon completion.  Once the upfront payment has been made, I will gladly send out WIPs to keep you posted on the process of your piece. Just ask! 
  • Finished work will not be sent out until payment is complete.  If you wish to preview the finished image before completing your payment, you may request this. In which case, I will send a low resolution version with heavy watermarking.  This, unfortunately, has been made necessary to prevent theft.   I will not, under any circumstances, send out PSDs or Sai files.  
  • If you are under 18 or using someone else's account to pay, make sure beforehand that you have their permission. I will not be held responsible if you make a decision to violate someone else's trust, and I am in no way accountable for this.  I will not, under any circumstances,  refund your money here.
  • I will not compromise prices based on your personal circumstances.  If you cannot currently afford a piece of art, it is on you to save up the needed funds and come back.  
  • Expressing your personal financial or emotional situation to me will not change this.   Unfortunately, there are enough people out there who would comprise a sad story in order to scam artists into lowering their prices that I can no longer offer any wiggle room at all here. 

Posting Elsewhere:
  • You may post any work commissioned by you elsewhere. If you would like to repost it, or use it to represent something you do, you are most welcome to!  However, when you do, please accompany it with credit and a link back to me, so that those who enjoy the artwork can then have an opportunity to find me and see more.  This helps me very much, and I appreciate your cooperation! (If you decide to use a piece I've done for you elsewhere, I would love it if you'd send me a link so I can see what you've decided to do with it.  It's always fun to see how people are enjoying something I've created for them).
  • You may NOT, however, post work that wasn't specifically done for you without asking me first.  It has a story and soul and meaning to someone else, and that belongs to them.  I have to ask that you please, for the sake of everyone, be respectful of this.  
  • If you'd like to share a piece of artwork what wasn't done for you on something like a tumblr or journal, shoot me a note and ask me.  In many cases I'm alright with it, providing the image doesn't contain content belonging to someone else.  And honestly, it's always flattering to hear when someone enjoys what I do enough to want to share it in their own ways!  

Rights:
  • As an artist, I do retain an amount of ownership over what I create.  The characters, stories and situations you've dreamed up, of course, belong to you. However, the artwork itself remains a product of my time, love and effort.  
  • I may from time to time use a piece done for you to promote my work, or in order to provide an example of what I can do.  I'm proud of the creations I make for you guys!  If you would prefer that I not share a piece done for you, please let me know.  
  • In a situation where you have me design your character's appearance for you entirely, you may do what you like with the resulting character. However, I do retain creative rights for the design itself.   I do NOT, as some will, surrender all ties to my designs.

Tips:
  • While it is not required, I do gratefully accept tips! They serve as an affirmation that all the love and personal attention I put into everything I do is appreciated, and it really is encouraging.  Even a very small amount carries this message, and makes my day every time.  For everyone who has tipped in the past, or plans to in the future:  THANK YOU!! From the bottom of my heart, I mean that!

Sales:
  • Occasionally, I'll announce a sale either here, on my various social media sites, or on FA.  In order to get the sale price, it is your responsibility to mention it! I will not remind you during the stream or right before you pay.    The reason for this is, I post special offers as rewards for folk who enjoy my work enough to actively follow it!  So, be sure to mention it before sending your payment to confirm.  
  • If you're interested in discounted work, give one of my various social media things a follow.  That's the best way to catch all the promos and discounts and fun events I do.
